Zambian-American Influencer's Prison Sentence: Freedom of Speech or Hate Speech? (2025)

A shocking sentence has been handed down to a Zambian-American influencer, Ethel Chisono Edwards, known online as 'One Boss Lady'. She has been sentenced to 18 months in prison for hate speech, sparking a heated debate in Zambia. But here's where it gets controversial: is this a necessary move to curb online abuse, or a violation of free speech?

Ethel, a 42-year-old estate agent from New York, has a substantial online following. Her rants about Zambia's President Hakainde Hichilema have gained her notoriety over the past two years. Three months ago, she was arrested at the main airport in Zambia while attending her grandmother's funeral. In court, she pleaded guilty and apologized to the president, but the magistrate, Webster Milumbe, emphasized the need for a strong warning, citing the rising prevalence of hate speech.

Edwards was convicted under the Cyber Security Act and the Cyber Crimes Act, new legislation enacted this year. She admitted to using a computer to publish offensive statements, motivated by hatred, with no lawful excuse. Her lawyer, Joseph Katati, described her as a first-time offender with potential, highlighting her role as a breadwinner and philanthropist who sponsored a girls' football team in Zambia.

In a detailed apology, Edwards stated, "I want to unreservedly apologize to the president, Mr. Hakainde Hichilema, his family, and the nation of Zambia for my words and their potential negative impact." This stands in stark contrast to her bold online persona.

The magistrate acknowledged the plea for leniency and backdated the sentence to the time of her arrest. Katati mentioned that he hadn't received instructions from Edwards regarding an appeal.

This case has divided Zambians. Some argue it's a necessary step to maintain order, while others believe it infringes on freedom of expression. Hichilema, who took office in 2021, has abolished criminal defamation laws against the president, but Zambians can still be prosecuted under other laws. In September, two men were sentenced to two years in prison for attempting to use witchcraft against President Hichilema.

So, what's your take on this? Is this a fair sentence, or does it go against the principles of free speech? Let us know your thoughts in the comments below!
